Terms and Conditions

These Terms and Conditions govern your use of iNoon, a macOS application published by Cosmic Noon PTY LTD in Western Australia.
1. Acceptance
By installing, opening, or using iNoon, you agree to these Terms and Conditions. If you do not agree, do not use the application.
2. The Application
iNoon helps you view, organise, back up, and work with information from iPhone and iPad devices that you connect to your Mac or make available on your local network.
You are responsible for ensuring that you have the right to access, view, copy, back up, export, or modify any device data you use with iNoon.
3. Licence
Cosmic Noon PTY LTD grants you a limited, personal licence that is not exclusive or transferable to use iNoon on macOS, subject to these Terms and any licence or purchase terms that apply to your copy of the application.
You must not reverse engineer, redistribute, resell, sublicense, or misuse iNoon except where permitted by law or by the licence terms of components supplied by third parties and included with iNoon.
4. Third Party and Open Source Components
iNoon may include or use software components from third parties, command line tools, dynamic libraries, frameworks, or services. Some components are provided under separate open source licences, including permissive licences and copyleft licences such as the GNU Lesser General Public License.
Those components from third parties are licensed to you under their own licence terms, not under the proprietary iNoon licence above. Nothing in these Terms limits rights granted by an applicable licence from a third party, including rights to inspect, modify, replace, debug, copy, or redistribute a component where that licence permits it.
Notices and licence texts from third parties are included with iNoon or made available on its website. If there is a conflict between these Terms and an applicable licence from a third party, that licence controls for the relevant component.
5. Local Data and Backups
iNoon is designed as a local Mac application. Device information, backups, exports, application settings, logs, and related files may be stored on your Mac or in locations you choose.
You are responsible for managing those files, including their security, retention, deletion, and any backups you create.
6. Optional Crash Reporting
If iNoon closes unexpectedly, it may create a technical crash report locally and ask whether you want to send it. Reports are not sent automatically. You may review, copy, dismiss, or submit a report, and declining has no effect on your use of iNoon.
If you choose to submit a report, it may include the crash date, app and operating system versions, technical application, process, thread, binary, stack trace, register, and error information, and any optional description you provide. Crash reporting is not designed to include content from connected devices, but technical logs and text entered by users can contain unexpected or personal information, so you should review the report before sending it.
Submitted reports are sent to Cosmic Noon PTY LTD, stored in the backend of the iNoon website hosted by Hostinger, and processed in Australia for crash investigation, support, security, and reliability improvement. Crash reports are handled in accordance with the iNoon Privacy Policy.
7. Device Access
iNoon may ask macOS, iOS, or iPadOS for permission to access connected devices, files, folders, backups, and system services. Some features require a trusted device connection, local permissions, or passwords controlled by you.
If you remove a device from iNoon, the application may delete records managed by iNoon and local iNoon data for that device. It does not remove the physical device from your Apple account or erase the device itself unless a feature clearly says otherwise.
8. Artificial Intelligence
iNoon may include optional features assisted by AI, including summaries, extraction, explanations, drafting, classification, or agent workflows.
AI features can be inaccurate, incomplete, or unsuitable for a particular purpose. You should review AI output before relying on it, sharing it, or taking action based on it.
Some AI features may run locally. Other AI features may use providers that you configure, such as external model or API providers. When you choose to use an external provider, the content you submit may be sent directly from your Mac to that provider, and that provider's terms, privacy policy, retention rules, and fees apply.
Cosmic Noon PTY LTD does not provide legal, medical, financial, or professional advice through iNoon or its AI features.
9. Third Party Services
iNoon may interact with Apple software, Hostinger, device services, file systems, optional AI providers, and other services from third parties. Cosmic Noon PTY LTD does not control those services and is not responsible for their availability, behaviour, policies, pricing, or changes, except to the extent responsibility cannot be excluded by law.
10. Device Operations and Risk
iNoon may perform or assist with operations involving a connected device, including backups, restores, software updates, data transfers, file access, and device management. These operations depend on Apple software and services, the condition and compatibility of the device and computer, available storage, cables, network connections, power, security settings, and other factors outside the control of Cosmic Noon PTY LTD.
Before starting an operation, you should keep a current independent backup, ensure the device and computer have sufficient power and storage, use a stable connection, and read all instructions and warnings. You are responsible for selecting, authorising, and monitoring operations performed with iNoon.
To the maximum extent permitted by law, Cosmic Noon PTY LTD is not responsible for device malfunction, loss of device access, recovery mode, a failed or interrupted update or restore, data loss, data corruption, or any other device issue arising from the use or attempted use of iNoon, an interruption, an incompatibility, or a service or component outside its control.
This section does not exclude or limit liability for fraud, wilful misconduct, gross negligence, or any guarantee, right, remedy, or liability that cannot lawfully be excluded or limited.
11. No Warranty
To the maximum extent permitted by law, iNoon is provided on an "as is" and "as available" basis. Cosmic Noon PTY LTD does not guarantee that iNoon will be uninterrupted, free of errors, compatible with every device, or suitable for every use case.
Nothing in these Terms excludes rights or guarantees that cannot be excluded under applicable law.
12. Limitation of Liability
To the maximum extent permitted by law, Cosmic Noon PTY LTD is not liable for indirect, incidental, special, consequential, or punitive loss, including loss of data, loss of profit, interruption, device issues, or problems caused by services from third parties.
13. Changes
Cosmic Noon PTY LTD may update iNoon and these Terms from time to time. Continued use of iNoon after an update means you accept the updated Terms.
14. Governing Law
These Terms are governed by the laws of Western Australia, Australia. Courts with jurisdiction in Western Australia may hear disputes relating to these Terms.
