iNoon Mobile · Terms and Conditions
Effective date: 19 October 2026
These terms cover iNoon Mobile for iPhone and iPad, published by Cosmic Noon PTY LTD, Western Australia, Australia.
1. About these terms
Apple’s Standard EULA applies to App Store downloads unless another application licence is specified in the App Store. These terms describe use of iNoon Mobile and do not replace that licence, third-party software licences or mandatory consumer rights.
2. Your files and permitted use
You keep ownership of your files. Only access, copy, share or play material you are authorised to use. You are responsible for permissions and for respecting other people’s privacy and intellectual property rights.
3. Misuse and unauthorised access
Do not use iNoon Mobile for unlawful activity, unauthorised access, infringement of privacy or intellectual property rights, distributing harmful software, or bypassing security or copy protection. Only connect computers and services you trust, and protect access to your devices. You are responsible for your own unlawful or unauthorised use; Cosmic Noon does not authorise or endorse it. Restrictions on copying, modifying or redistributing the app are subject to applicable law and the rights granted by third-party and open-source licences.
4. Transfers, sync and deletion
Copying, moving, overwriting, deleting and syncing can permanently change or remove files and metadata. Depending on the sync style, changes and deletions can propagate between your device and one or more computers, including after reconnection. Check folder locations, sync direction, deletion rules and connected computers before enabling sync. Keep separate, current backups of important files and check that you can restore them. Sync is not a backup or a recovery service. Verify transfers before deleting originals. Deleting the app can remove its local files; export or back them up first. Removing a sync or hiding files does not undo completed operations, erase other copies or revoke a computer’s existing trust.
5. Optional desktop app
iNoon desktop is optional, separately distributed software with its own terms, privacy practices and licence requirements. Mobile file management and playback do not require a desktop purchase or iNoon account. Computer sync requires compatible desktop software, an authorised connection and the computer app to be running.
6. Playback and third-party software
Supported formats depend on the file, codec, device and operating system. Playback of every file is not guaranteed, and iNoon does not bypass copy protection. VideoLAN and other open-source components retain their own licences; notices and source information are available in the app.
7. Availability and warranties
Subject to Your legal rights below, iNoon Mobile is provided as is and as available, without additional warranties to the extent permitted by law. We do not guarantee uninterrupted or error-free operation, compatibility with every file, device or future operating system, or that lost or damaged data can be recovered. Transfers depend on available storage, power, connections and compatible software. iNoon Mobile is not designed for safety-critical use where a failure could cause death, injury or serious physical or environmental damage.
8. Limits on liability
Subject to Your legal rights below and to the maximum extent permitted by law, Cosmic Noon PTY LTD excludes liability for indirect, incidental, special or consequential loss, including lost profits, business interruption, and loss or corruption of data arising from use of, or inability to use, iNoon Mobile. For liability that may lawfully be limited, our total aggregate liability for all claims relating to iNoon Mobile is limited to the greater of AUD 100 and the amount you paid for iNoon Mobile in the 12 months before the event giving rise to the claim. This is a total limit, not a limit per incident. These limits apply regardless of whether a claim is in contract, tort or otherwise. We are not responsible to the extent a loss is caused by your unlawful use, unauthorised access you permit, or events outside our reasonable control and is not caused or contributed to by our breach or fault. A failure to keep backups does not by itself remove your statutory rights.
9. Your legal rights
Nothing in these terms excludes or limits consumer guarantees, remedies or other rights that cannot lawfully be excluded, including under the Australian Consumer Law and mandatory laws where you live. The warranty exclusions and liability limits do not apply to our fraud, wilful misconduct, gross negligence, death or personal injury caused by our negligence, or any other liability that cannot lawfully be excluded or limited. These terms do not reduce rights granted by the applicable Apple application licence. Western Australian law applies only to the extent consistent with those mandatory protections. If a provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law.
10. Updates and contact
We may update the app and these terms as features or legal requirements change. Updated terms will carry an effective date in the app and on the website. Questions about these terms can be sent to info@inoon.app.
